Myanmar’s observations on the Secretary-General’s report on Myanmar, contained in Document No. (A/81/302)

The United Nations Secretary-General’s report on the human rights situation in Myanmar (A/81/302), to be submitted to the Third Committee meeting during the 81st Session of the United Nations General Assembly (UNGA), has been released.

Pursuant to General Assembly resolution (80/221), the UNSG issued this report for the period from 1 August 2025 to 31 July 2026. The report presents extensive one-sided allegations and accusations about Myanmar’s political, social, and economic conditions.

By ignoring the government’s efforts to promote peace, stability, and development, the report merely reiterates the familiar rhetoric of opposition groups, full of fallacious arguments, as in previous reports. Its content is largely based on allegations from various so-called mandate holders. Furthermore, the data presented in the report appears to have been sourced primarily from anti-government entities and external media outlets. This raises serious concerns about the report’s objectivity, impartiality and balance.

While the following rebuttals address specific accusations in the UNSG’s report, this does not make the document’s remaining unsubstantiated claims acceptable.

Reference is made to the humanitarian section under subsection 2 and paragraph 74 of the report. Myanmar is committed to providing humanitarian assistance in a timely and non-discriminatory manner, while constantly prioritising the safety of humanitarian personnel. Despite restrictions imposed on Myanmar by the United Nations, Myanmar, as a responsible State, continues to host UN Agencies on its soil and facilitates their operations within the country. Currently, 17 UN agencies are operating across the country, with 276 international personnel and 7,626 local personnel. Furthermore, UN agencies are currently implementing 43 projects, and international non-governmental organisations are implementing 88 projects.

From 2021 to July 2026, Myanmar has smoothly facilitated 46 visits by high-ranking officials from the UN and international organisations, over 2,300 diplomatic visits (including 353 visits between January and September 2026), and 106 travel authorisations for UN staff. Furthermore, the National Solidarity and Peace-making Negotiation Committee (NSPNC) has coordinated with UN agencies including UNOCHA, UNHCR, UNICEF, WFP, and UNFPA to facilitate assistance in more than 20 townships across Kayin, Rakhine, Shan, Chin, Magway, and Sagaing regions. As Myanmar is an agricultural-based nation, it continues to maintain domestic food self-sufficiency, and continued efforts are being made for the sustainable development of the agricultural sector.

Reference is made to paragraph 18 of the report. Myanmar is making every effort to prevent and effectively combat various forms of transnational organised crime. The State Government has successfully implemented law enforcement operations targeting illegal drug trafficking, human trafficking, and scams and online fraud involving cross-border communication networks. To strengthen these efforts, the Hluttaws enacted the Anti-Online Scam Bill on 31 July 2026. Transnational organized crime is not confined to any single country; rather, it is a global challenge that affects all countries and requires collective international action and cooperation.

According to investigations, 99 per cent of the perpetrators involved in these crimes are foreign nationals who illegally entered Myanmar through neighbouring countries and participated in online scam operations. As of 4 October 2026, a total of 73,085 foreign nationals from 59 countries involved in online scam operations have been repatriated to their respective countries. Myanmar’s security forces are also actively working to identify and effectively crack down on criminal networks.

This refers to paragraph 31 of the report. It is clarified that the Myanmar Government’s implementation of the Central Equipment Identity Register (CEIR) system primarily aims to prevent the illegal importation of mobile devices, theft, and illicit activities involving communication networks, in accordance with international standards. The system is intended to support law enforcement and maintain public security, without intending to violate individual privacy.

Reference is made to paragraph 48 of the report. Myanmar grants citizenship status to those who meet the criteria stipulated in the 1982 Myanmar Citizenship Law. Myanmar does not recognise the term “Rohingya,” which has never existed in legal and historical records of Myanmar. According to the records, there were more than 740,000 residents in northern parts of Rakhine State before the terrorist attacks launched by ARSA in August 2017. Following the incidents, 540,000 people were displaced to Bangladesh, and more than 200,000 remain in these areas.

The Government remains committed to facilitating the voluntary return of verified individuals who left Rakhine State and is continuing necessary verification processes accordingly, with strict adherence to the signed agreements between the two countries. As of 30 September 2026, of the 828,824 individuals listed by Bangladesh in six batches, Myanmar has verified 449,193 individuals. Myanmar found that 326,376 individuals were former residents in Rakhine State, 4,254 individuals were found to have been involved in terrorist acts, and the data of 118,563 individuals could not be verified. Myanmar reiterates its commitment to receive the verified displaced persons under the bilateral arrangements once security and stability in northern Rakhine are more favourable. Under the 1982 Citizenship Law, over 13,000 Bengalis have been granted citizenship status between 2025 and the present across the country, including over 6,200 Bengalis in Rakhine State.

Adopting this discriminatory draft report without the consent of the concerned country demonstrates a failure to uphold the principle of sovereign equality. It undermines impartiality and fairness, and reflects/represents the application of double standards, exceptionalism, and selectivity in addressing humanitarian and human rights issues.

Therefore, the Myanmar Government dissociates itself from and categorically rejects the entire report contained in document A/81/302, along with its intrusive observations and recommendations.
